Prenuptial AgreementsPrenuptial agreements are legally binding contracts that are entered into by you and your future spouse in anticipation of marriage. In essence, they provide for what will happen to your assets in the event of a divorce. This agreement will supersede what would otherwise be the law relating to the distribution of such assets in the event of a divorce.Prenuptial agreements should be considered if you own a successful business, you have significant assets, you have considerably more money than your future spouse, you have children from a previous marriage, or you will be supporting your spouse while s/he attends school. Each party needs to have independent legal counsel and both parties must sign the agreement voluntarily, with a full understanding of all of its terms. All relevant information must be disclosed by both parties and hiding of assets could invalidate the agreement. |
